James O’Hara acted for IK in an application pursuant to Section 23 PoCA 2002 (formerly known as a certificate of inadequacy application). IK had a Confiscation Order made against him in 2016 for just over £4,000,000. The prosecution had resisted an application for a significant period of time, and in the meantime IK’s default sentence had been activated.
Following the submission of evidence, the prosecution agreed with the submissions made in the Section 23 application, and the Confiscation Order was reduced by £2,100,000. As a result of the reduction, IK was released from prison.
